MyAXA Portal Terms and Conditions


  • Under these Terms and Conditions, "you" refers to the Policyholder who has applied for and has been granted access to your dedicated MyAXA portal in order to access various documents relating to your AXA Travel Protection Plan (the "MyAXA Portal") and "we" or "us" refers to AXA Assistance USA, Inc. (“AXA”) (in California, doing business as AXA Assistance Insurance Services, Producer License Number 0H74893).
  • Please read these Terms and Conditions carefully before you start to use the MyAXA Portal. By using the My AXA Portal, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these Terms of Use, you must not access or use the MyAXA Portal.
  • By agreeing to these Terms and Conditions, you confirm that you are at least 18 years of age. If you have purchased the Travel Protection Plan for an individual under the age of 18, you hereby confirm that you are his/her parent or legal guardian or other responsible adult.
  • You understand that the MyAXA Portal includes descriptions of the benefits available for a travel protection plan. Travel plans contain insured and non-insured services. Insured benefits and non-insured services are subject to benefit reductions, limitations, exclusions and termination provisions. Full details of insured benefits are contained in the AXA Travel Protection Plan Document (“Plan Document”) available to you for download on the MyAXA Portal. Full details of non-insured assistance services are included in the Plan Document. For additional information about plan limitations or to request to receive your Plan Documents by mail, please contact AXA at USTravel@axa-assistance.us.

    The insurance benefits in the Plan are underwritten by Nationwide Mutual Insurance Company and affiliated companies including Nationwide Life Insurance Company, Columbus, Ohio. Benefits are administered by AXA Assistance USA, Inc. (in California, doing business as AXA Assistance Administrators, TPA License Number 0H74893). Non-insurance assistance services are provided by AXA Assistance USA, Inc. and are not underwritten by Nationwide Mutual Insurance Company.

    The insurance policy provided as part of the AXA Travel Protection Plan provides coverage only related to Your Trip. You may have coverage from other sources that provides you with similar benefits subject to different restrictions. You may wish to compare the terms of this policy with your existing life, health, home, and automobile insurance policies. If you have any questions about your current coverage, call your insurer or insurance agent or broker. Your travel retailer may not be licensed to sell insurance in all states, and therefore cannot answer technical questions about the benefits, exclusions, and conditions of this insurance and cannot evaluate the adequacy of your existing insurance. This policy may not provide coverage for or may limit coverage related to pre-existing conditions. The purchase of travel insurance is not required in order to purchase any other product or service. In addition to your policy, the product you are purchasing may contain other non-insurance services and/or cancellation fee waivers offered by companies other than Nationwide.

    • Maryland Residents: The offered insurance coverage may duplicate certain provisions of insurance coverage already provided by the purchaser’s homeowner’s insurance, renter’s insurance, health insurance, or similar insurance coverage. The Commissioner may be contacted to file a complaint at: Maryland Insurance Administration, ATTN: Internal Consumer Complaint Investigation (Property/Casualty), 200 St. Paul Place, Suite 2700, Baltimore, MD 21202.
    • Delaware Residents: The offered insurance coverage may duplicate certain provisions of insurance coverage already provided by the purchaser's homeowner’s insurance, renter’s insurance, health insurance, or similar insurance coverage. The purchase of travel insurance would make the travel insurance coverage primary to any other duplicate or similar coverage.
    • California Residents: For additional information, contact the California Department of Insurance Consumer Hotline, 800-927-4357 or 213-897-8921.
    • New York Residents: The licensed producer represents the insurer for purposes of the sale of the insurance. Compensation paid to the producer may vary depending on the policy selected, the producer’s expenses, volume of business, or the profitability of the insurance contracts. Except as otherwise provided by law, the purchaser may request and obtain information about the producer’s compensation based on the sale or any alternative quotes by requesting such information from the producer.
  • Your satisfaction is important to us. If you are not satisfied for any reason or wish to make changes or cancel your Travel Protection Plan, please notify AXA as soon as possible. In the event of a plan cancellation, we will refund any unearned plan cost to you within 10 days of the cancellation request, or according to the terms of your Plan Document.   • COUNTRY RESTRICTIONS:

    You acknowledge that due to U.S. or other applicable trade or economic sanctions, laws, regulations and/or other reasons, AXA Assistance USA does not provide travel protection plans for travel to the following countries/regions: Afghanistan, Belarus, Burundi, Central African Republic, Chad, Congo, Crimea/Sevastopol/Luhansk/Donetsk, Eritrea, Guinea, Iran, Iraq, Lebanon, Liberia, Libya, Mali, Niger, North Korea, Pakistan, Russia, Sierra Leone, Somalia, South Sudan, Sudan, Syria, Ukraine, Venezuela and Yemen. Accordingly, no services will be provided, including, but not limited to, the payment of any claims, in connection with travel to these countries and regions. Should new sanctions be imposed that prohibit AXA Assistance USA from covering travel to any additional countries, travel to such countries shall be excluded from this coverage.

    CUBA:

    Please note that if you are purchasing this Plan for travel to Cuba, your policy will be valid only if you are traveling to Cuba under the authority of a specific license issued to you, or general license published by, the Office of Foreign Assets Control (OFAC) and your travel comports with such authorization. AXA Assistance USA will require proof that an applicable OFAC specific or general license authorized your travel to Cuba, as well as a description of the reason for travel, at the time of claim submission and may require additional documentation in order to satisfy compliance with U.S. economic sanctions. If required proof or other requested documentation is not provided, your claim payment may be delayed or denied. All claims must be for services related to the permissible reason for travel to Cuba.   • You will only access your dedicated MyAXA Portal through the use of your dedicated email link, which will be sent to the email address that you have provided us with. This email link is personal to you and will grant you access to the log-in page of your MyAXA Portal. The login page will require you to input additional information (as set out on the login page) in order for you to gain access to the home page of your MyAXA Portal (the “Additional Information”). The Additional Information will be personal to you and is required as an additional safety measure and should not be disclosed to anyone else. Your personal email link grant you access to your MyAXA Portal log-in page should not be shared with others. Should you have any reason to suspect that your MyAXA Portal has been compromised or used by another person without your consent, you must inform us immediately and we will issue with you with a new email link to access your MyAXA Portal. You also agree to ensure that you exit from your MyAXA Portal at the end of each session. You should use particular caution when accessing your MyAXA Portal from a public or shared computer so that others are not able to view or record your password or other personal information (as required) as part of the login page.
  • You will permit us to act on any instructions given through your MyAXA Portal when it is accessed through your dedicated email link. We will not be liable to you when we act on such instructions in good faith. If we act on such instructions, we will not verify the origin or authenticity of such instructions. Once we receive such instructions, they will be treated as irrevocable and binding on you whether or not there is any error or forgery or fraud concerning such instructions. We may (but will not be obliged to) cancel any instructions given under your MyAXA Portal without any liability if we know or have reason to believe that a criminal act, a fraudulent act, an offence or breach of any regulation or legislation will be or has been committed. We may refuse or stop carrying out any or all instructions or reverse any actions carried out arising from your instructions if we are of the opinion that such instructions are unlawful, not properly authorized by you or for any other reason whatsoever. We have the right to require confirmation in writing of any transaction from you. You agree that in all the situations stated above, we will not be liable for any resulting damages and losses. Any instruction given by you for your MyAXA Portal will be carried out in the normal course of business. We do not warrant that any instruction will be carried out within a particular time period or in any particular order.
  • We may at our absolute discretion cancel your use of your MyAXA Portal, vary, modify, withdraw, suspend or restrict your use of your MyAXA Portal or any of the electronic services, at any time without notice to you and without giving any reason. We will not be liable to you for any damages or losses that you may suffer as a result of such actions.
  • We do not guarantee that access to MyAXA, or any content on it, will always be available or by uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business, operational reasons or other any other reasons. We will try to give you reasonable notice of any suspension or withdrawal, however we are under no obligation to do so.
  • In using the Internet to gain access to your MyAXA Portal or in using the electronic services, we encourage you to ensure that you have and will maintain sufficient technical knowledge, appropriate safeguards and antivirus/malware systems whilst using the email link and Portal. If you do not, you may be exposed to the following risks:

    • If you do not have sufficient technical knowledge or you do not take safety precautions, unauthorized people may gain access to your computer or internet-linked devices.
    • Unauthorized people may without your knowledge gain access to your computer and monitor your regular access to your MyAXA Portal and your transactions with your MyAXA Portal
    • There may be computer viruses or other malicious software which may interfere with your access to your account.
  • We do not guarantee that our MyAXA Portal will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access our the MyAXA Portal. You should use your own virus protection software.
  • You must not misuse the MyAXA Portal by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to the MyAXA Portal, the server on which the MyAXA Portal is stored or any server, computer or database connected to the MyAXA Portal. You must not attack the MyAXA Portal via a denial-of-service attack or a distributed denial-of service attack. We reserve the right to report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the MyAXA Portal will cease immediately.
  • You acknowledge that use of the MyAXA Portal is entirely at your own risk and we will not be liable whatsoever for any potential loss of information and any implications resulting from this.
  • You confirm that the computer or internet-linked devices from which you are using to access your MyAXA Portal is free from computer viruses, malware, malicious code or software or bugs of any kind whatsoever. We will not be responsible for any computer viruses, malware, malicious code or software or bugs which may be due to internet services provided by any internet service provider. We will be entitled to change or modify MyAXA Portal from which you access your MyAXA Portal at any time without notice to you and without giving any reason. You will be solely responsible and liable for any damages or losses arising from your failure to comply with the above representation.
  • Whilst you should not provide you email link and login page details to anyone else, should you do so, you are responsible for ensuring that all persons who access our MyAXA Portal through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
  • Our records of all transactions carried out on your MyAXA Portal through the use of your login page will be conclusive and binding on you. If you:

    • fail to comply with the following Terms and Conditions;
    • disregard the security measures which you must take; or
    • fail to take precautions when using the internet to access your MyAXA Portal, we will not be liable to you for any losses or damages that you may suffer.
  • The MyAXA Portal is made available to you free of charge. All charges incurred, if any however, in accessing your MyAXA Portal will have to be borne by you.
  • Data Privacy

    By applying for an account or using the electronic services, you acknowledge and consent for AXA Assistance USA, Inc. and its respective representatives or agents to collect, use, store, transfer and/ or disclose the information, to or with all such persons (including any member of the AXA Group or any third party service provider, and whether within or outside of your country of residence) for the purpose of enabling AXA Assistance USA, Inc. to provide you with services required of an insurance provider, including the evaluating, processing, administering and/ or managing of your relationship and policy(ies) with AXA Assistance USA, Inc., and for the purposes set out in AXA’s Data Privacy Statement

  • Evidence of Transactions

    Our records of the transactions effected through your MyAXA Portal and your use of the electronic services, on our computer systems shall be accepted as conclusive and binding for all purposes. Your use of your MyAXA Portal and/or email link or use the MyAXA Portal will be recognized as your electronic signature and will be legally binding. You accept that electronic records will be admissible as original documents in any court of law and you agree that you will not challenge or dispute the accuracy or authenticity of such records.

  • Disclaimers

    • The information and material on your MyAXA Portal are provided on an "as is" and "as available" basis. We do not give any representations, guarantees or warranties (whether express or implied) as to the accuracy, adequacy, completeness or reasonableness of the information and materials contained in or accessed through your MyAXA Portal. We are not responsible for any errors in, or omissions errors in, or omissions from, such information and materials. We do not give any warranties of any kind, implied, express or statutory (including but not limited to, warranties of title, merchantability, satisfactory quality, non-infringement of third-party intellectual property rights, fitness for a particular purpose) in connection with such information and materials, or the MyAXA Portal in general.
    • The information and materials provided on your MyAXA Portal are for your information only and we will not be liable to you for any losses or damages suffered as a result of any action you may take or omit to take in reliance of the information and materials contained in or accessed through your MyAXA Portal.
  • Prohibitions

    The materials and information on your MyAXA Portal belong to us. Such materials and information may not be posted, copied, distributed, uploaded or reproduced in any manner whatsoever. You may not insert a hyperlink to your MyAXA Portal or any part thereof on any other website/application or "mirror" or frame your MyAXA Portal, any part thereof or any information or materials in your MyAXA Portal on any other server or website/application.

  • Intellectual Property

    • We are the owners and proprietors of all the marks, whether service or trademarks, logos on your MyAXA Portal. As such, they may not be published, transmitted, reproduced, performed, displayed, adapted, distributed, stored, broadcast, stored, altered, hyperlinked or otherwise used in whole or in part in any manner without our express prior written consent.
    • Notwithstanding Paragraph 23.1 above, you may print off one copy, and may download extracts, of any page(s) from your MyAXA Portal for your personal use. You must not modify the paper or digital copies of any materials you have printed off or downloaded from your MyAXA Portal in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. If you print off, copy or download any part of the MyAXA Portal in breach of these terms of use, your right to use our MyAXA Portal will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
    • Any pictures or images or audio materials or video materials displayed on your MyAXA Portal belong to us or are displayed by us with the permission of the owners of these pictures or images or audio materials or video materials. The use of these pictures or images or audio materials or video materials is strictly prohibited.
    • Any information that you transmit to us via your MyAXA Portal will be treated as non-proprietary and will become our property. Such information may be used for any purpose, including but not limited to reproduction, solicitations, disclosure, transmission, publication, broadcast and casting. We are free to use any ideas, concepts or know-how contained in any communication you send to us via your MyAXA Portal.
  • Limitation of Liability

    • We will not be liable to any third party accessing your MyAXA Portal from whatever location, for any direct, indirect or consequential damages which may occur due to the use or inability to gain access to the electronic services, information or materials on your MyAXA Portal, or reliance on any such information or materials provided on your MyAXA Portal even if we or any of our representatives have notified of this possibility of incurring such damages.
    • Likewise, we will not be liable or responsible for any damages suffered as a result of any computer viruses malware, malicious code or software or bugs of any kind whatsoever downloaded into any computer or internet-linked device as a consequence of downloading any materials, images or data from your MyAXA Portal or from using and accessing your MyAXA Portal.
    • In addition, we will not be liable for any losses or damages whatsoever and howsoever occurring whether or not arising from or in connection with your access to your MyAXA Portal including any direct, indirect, special, consequential or special losses or damages, loss of profits, loss of opportunity, loss of business or goodwill, loss of interest and including:

      • our acting on instructions given through the use of your login page whether or not authorized by you;
      • any destruction or delay or alteration of any instructions, information transmitted or received by you through your MyAXA Portal or any mistake in the transmission of the instructions, information transmitted;
      • reliance on the information accessed by your MyAXA Portal through the use of your login page;
      • any unauthorized use of and/or information relating to your MyAXA Portal which is obtained by a third party as a result of your access to your MyAXA Portal;
      • any stoppages or interruptions of the MyAXA Portal on which you access your MyAXA Portal ;
      • any disclosure of information to third parties due to your negligence or failure to keep your login page details confidential;
      • any losses or damages associated with software defects, hardware breakdowns, network vulnerabilities, malicious attacks, security shortcomings, hacking incidents, fraudulent activities and system failures which may occur despite our best efforts;
      • any interruption or ceasing of the operation or availability of your MyAXA Portal; or
      • any losses or damages from cyber attacks e.g. denial of service attacks which may occur despite our best efforts.
      • If we are held liable, we shall only be responsible for direct losses or damages which may be reasonably expected to result from any of the circumstances and only if such losses and damages were caused by our gross negligence or willful default.
    • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • Indemnity

    We will not be liable for and you will indemnify us against any claims, losses, damages or expenses (inclusive of all legal costs on a full indemnity basis) howsoever caused which may be incurred by us in providing access to your MyAXA Portal to you whether or not arising from but will not be limited to the following:

    • our taking any instructions and acting upon such instructions made through your MyAXA Portal accessed by way of your email link and login page;
    • the improper or unauthorized use of your MyAXA Portal;
    • any act or omission by any internet service provider;
    • any delay or failure in transmission, dispatch or communication facilities; or
    • any access (or inability or delay in accessing) and/or use of any browser to allow access to your MyAXA Portal or for any defect in any such browser.
  • Variation or Modification of Terms and Conditions

    We may at any time at our absolute discretion vary or modify any of the Terms and Condition. Any changes to the Terms and Conditions will be posted on the MyAXA Portal and are effective immediately when we post them. Your continued use of the MyAXA Portal following the posting of the varied or modified Terms and Conditions means that you accept and agree to the changes. You are expected to check this page regularly so you are aware of any changes, as they are binding on you.

  • Entire Agreement

    These Terms and Conditions and AXA’s Privacy Statement (as set out in paragraph 19) constitutes the sole and entire agreement between us regarding the MyAXA Portal and supersedes all prior agreements between us regarding the MyAXA Portal.

  • Assignment

    We may transfer our rights and obligations under these Terms and Conditions. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Terms and Conditions.

  • Waiver

    No failure or delay by us in exercising or enforcing any right or option under the Terms and Conditions shall operate as a waiver thereof or limit, prejudice or impair our right to take any action or to exercise any right as against you or render us responsible for any loss or damage arising therefrom.

  • Severability

    If any one or more of the Terms and Conditions are deemed invalid, unlawful or unenforceable in any respect under any applicable law, the validity, legality and enforceability of the remaining provisions of the Terms and Conditions shall not in any way be affected or impaired.

  • Third Party Rights

    The parties to this agreement governed by the Terms and Conditions for your MyAXA Portal do not intend that any of its terms shall be enforceable by any person not a party to it. The parties reserve the right to rescind or vary these Terms and Conditions without the consent of any third party.

  • Governing Law and Jurisdiction

    The Terms and Conditions are governed in all respects by the laws of the State of Illinois, without giving effect to any principles of conflicts of laws. Any dispute concerning the Site or these Terms and Conditions shall be subject to the exclusive venue of a court of competent jurisdiction in Chicago, Illinois.
